Hi
This evening I had neighbour came over walk straight in my work shed walking on bare feet lucky he didn’t received injured from cut off metal lying on the floor made verbal nasty complaining that l have been using 100 mm angle grinding steel pipe removing rust for my new windmill for few hours in the morning 9,30 to 11am,afternoon 4.00 to 6.00 pm and l live in rural area surround by tree and bush and they live just over 205 metre from my home and their house are on front of busy road where heavy trucks and cars passing his home everyday and my next door neighbour other side just 110 metre from my house is 30 metre to my shed and none of my family or next door neighbour 110 metre never complaining about the noise however this neighbour that live 205 metre always complaining on everything including small generator, burning off dead trees ( Got permit from fire warden) and they were not home at the time when the fire was down few hours later still complaining after the came home and later he came over my land and asked me about the fire permit because he has been refuse issue by fire warden but got mine ok now l had look Gatton Council noise law webs site find nothing on it so 100 mm angle grinder and rarely use9 inches grinder has been use at my home for more than 12 years So now facing more neighbour feud again So what next ??

Sounds like you have a serial pest on your hands....Get a bigger grinder, build a bigger fire and take the muffler off the generator.Did you ask him if he had a permit for the noise pollution escaping from his mouth. Next he will complain about the mill.

Hi Dwyer

There isnt any restriction on using power tools between 7am and 6pm on private land, so I think it's his empty head echoing in time with your noise, buy a noise meter and get some readings on the noise generated by your tools at 30 meters, record it and have it for reference with the council should he complain to them.

He must be on drugs as only someone on DRUGS would be silly enough to walk into a workshop with bare feet, HINT NINT.

Put a sign on your front gate stating that, uninvited persons entering this property can be charged with tresspassing at the discretion of the owner.

Application for entry of uninvited persons can be lodged in writing on an "Entry Permission Form" completer in triplicate, entry permission form is available from the propert owner on request in writing to the owner, one copyof the form to be kept by the applicant,to be produced on entry at the appointment time, one copy to be lodged with the local police, and one copy sent the property owner by regestered mail no less than 30 days before the required entry date.

All copies of the "Eentry Permission Form" to be notorized by a Justice of the Peace, or by a Police Officer of the rank of Seargant or higher.

The owner of the property will then reply to the request of the applicant by 7 days before the proposed entry date with a entry appointment, or rejection to enter, in writing.

Legal bu***hit for sure, but the world is now full of it, so use it to your own advantage.

Next day I contacted my local council to check about the problem with my neighbour complaining the angle grinding noise is fine along within the certain hours so i asked about the decibel for angle grinder making noise approx 120 decibel recording by EPA book but no information about the distance at 223 metre from my serial pest neighbour house but i know is approx max 30 metre however still no record from EPA rule in their book. Anyway came home start to finish my work and 1and half hours later in the afternoon, i wasn’t aware my neighbour came back and this guy again walk though my workshop while i doing grinding outside back of my shed and came over to me and made an apology to me for what happened yesterday and we had had a nice chat and i told him that he was very lucky as i was going to pick him up and throw him into a old bath tub where my cattle drink their water and also question “How can you& family cope with heavy truck and cars noise front his home only 30 metre from main road” and got no reply and he was wearing his motor bike boot this time not bare feet as content himself as bikie feller with goat beard so from now on l will be buying some Safety sign to put a sign on my front gate stating that, uninvited persons entering this property can be charged with trespassing at the discretion of the owner. Including “Do Not Enter the Workshop” unfortunately l still don’t trust this guy as known him for 10 years still having feud with other neighbours as well
Poss I didn’t have 9 inches grinding wheel left and done land cleaning, dead tree ready for bigger fire in next several week time

make sure you lock your workshop... its amazing how often tools "break" or go missing in situations like that.

Hi Powernut
Thank for your comment and in the last few days I have becoming more suspicious and more aware that tools and things will go missing "break in" I should put up some safety entry permission signs like “Keep out” or “Tool in Use” at front farm gates what ever I find might make more attractive to thieves once they see the sign is making the harder for me to think if we go away from home for short times and I come home and find out someone has broke in so if anyone can give me the best advice about safety signs or maybe install a security camera or what?

Pragmatically life will be simpler if you don’t have a feud with him.

He may be difficult (or just a nut).

Comply with the council bylaws and life should be simple.

If what you say is true a council inspector seems unlikely to take his side.

They may test the noise at the boundary.

Assuming that you aren’t being noisy at 2 AM

Set up sign which reads:

TRESPASSERS WILL BE PROSTITUTED!

That should fix him!

PLENTY v. DILLON (1991) 171 CLR 635 F.C. 91/004 - (HIGH COURT OF AUSTRALIA) states in part...

a) Consent to an entry is implied if the person enters for a lawful purpose. In Robson v. Hallett (1967) 2 QB 939, Lord Parker C.J. said (at p 951): "… the occupier of any dwelling-house gives implied licence to any member of the public coming on his lawful business to come through the gate, up the steps, and knock on the door of the house." This implied licence extends to the driveway of a dwelling-house: Halliday. However, the licence may be withdrawn by giving notice of its withdrawal. A person who enters or remains on property after the withdrawal of the licence is a trespasser. In Davis v. Lisle (1936) 2 KB 434, police officers who had lawfully entered a garage for the purpose of making enquiries were held to have become trespassers by remaining in the garage after they were told by the proprietor to "get outside".

It is almost Christmas. Does he have any children, perhaps one that would appreciate a nice drum as a present?
